Statutory Safety Audit
In some states like Maharashtra, the occupier is required to carry out safety audit as per Rule 3 of The Maharashtra Factories (Safety Audit) Rules 2014 (Applicable to all the factories mentioned in Rule 1 (2) of the same).
On the other hand, there is no specific legislation, in some states. But the occupier is required to carry out Safety Audit when such directions have been given by Authorities as required under a general duty of the occupier, (section 7A).
Additionally, the occupier of both the new and the existing industrial activity (MAH installation) is required to carry out an independant safety audit of the respective industrial activities with the help of an expert as per Rule 10(4) of Manufacture, Storage and Import of Hazardous Chemicals (MSIHC) Rules.
